The European Court of Justice has ruled that telemedicine services provided by doctors may also be delivered across national borders. The case concerned an Austrian dentist who provided telemedical aftercare for dental aligners through the app of a German provider. The Austrian Chamber of Dentists saw this as a breach of national rules, because the dental clinic is not exclusively in the hands of doctors, as is permitted under German law. Under Austrian law it would be prohibited.
The ECJ clarified that the law of the country in which the provider is established applies to telemedical care, in this case Germany.
The ruling is a landmark: telemedicine can be offered across borders without providers having to comply with the rules of every country their patients are in. What matters is the law of the country where the company is based.
